When you decide to move in to your new apartment, you should first draft an apartment rental agreement. This will not only give you legal protection but will also make the transition easier for you and your landlord. Drafting this agreement is not difficult. It just needs some work.

The first thing to do is to create a copy of your own. You can use this as a template to work on your own. In drafting your own, you have to take into account the uniqueness of your circumstances. You may be a tenant of a certain building or a landlord renting out his apartment. In both cases, the rules may be very different. Here are the general provisions that every rental agreement should contain:

Your landlord may not enter the apartment without first obtaining your permission. He is also not allowed to change the existing terms of the rental agreement without your consent. In case he does, he has to give you notice within a reasonable time, such as one or two months. This notice must specify that he will reinstate the existing terms of the agreement and the damages that he will shoulder in case you decide to terminate the agreement.

If the apartment is owned by more than one person, then it is important to put the right name on the agreement. For example, if both tenants are named Scott, the agreement has to be done accordingly. The same goes if there is more than one tenant in a building.

A typical tenant sign a lease with a promise to pay for the rent for a fixed number of years. This term is called the term of the lease. If the tenant fails to pay the rent for any reason, he is liable to the landlord. He may sue the tenant for the amount that he owes. In case the landlord does not honor the right to sue the tenant, he has the right to evict him from the apartment.

In certain circumstances, the tenant has the right to sublease the apartment. In such cases, he has to notify the landlord in advance and submit to his written permission. Failure to do so will result in the cancellation of the subtenant's right to sublease the apartment.

The landlord and tenant have to determine the amount of the rent in the first year of the rental agreement. The landlord has the duty to tell the tenant in the exact amount of the rent. After this amount, the landlord has the obligation to buy back the apartment at the end of the contract. If the tenant fails to pay the lease, the landlord has the right to sell it to recover the amount of the rent that was unpaid.

There are several types of rental agreements available in the market. However, it is better for you to choose a simple agreement. It is better if you check out the conditions of the apartment beforehand. Make sure that your expectations are fulfilled by the agreement. This will help you avoid unwanted issues that may crop up during the course of the agreement tenure.

Most often, the basic condition is the availability of the apartment for rent on or before a specific date. The landlord has to post this condition on the door of the apartment. Any violation of this condition is regarded as grounds for eviction by the tenant. Similarly, the premises should be in perfect condition. If there are damages, they must be repaired at the earliest or the tenant has the option of quitting the apartment.

There are certain rules that are supposed to be followed by both the tenant and the landlord. First, both the tenant and the landlord have to ensure that the apartment is kept clean at all times. Food stains, cigarette burns, vomit, or rubbish etc have to be cleaned up at the earliest. Stairs, carpets, or any loose shampoos or conditioners should be put away neatly. Anything that does not belong in the bedroom or bathroom should be kept outside.

If the tenant fails to maintain a clean apartment, the landlord has the right to inspect it. In case of any damage, the tenant has to immediately make arrangements to repair it. The landlord is also expected to keep the building and its surroundings clean. Anything that makes the apartment unfit for habitation has to be taken care of by the landlord.

Apart from this, both the tenant and the landlord have to follow the rules regarding the amount of rent that has to be paid. The apartment rental agreement should include a separate section that spells out the terms and conditions regarding the refunding of rent in case the tenant leaves the place before the agreed time period. This will help avoid any misunderstanding at a later stage.
